Welcome to Moon Peak, owned and operated by SRM Foods & Spices (“Company”, “we”, “us”, “our”). By accessing our website or placing any order, you agree to be bound by these Terms and Conditions, our Privacy Policy, and our Return & Refund Policy. If you do not agree with any part of these terms, please refrain from using our website.
1. General Use of Website
Users must be 18+ years of age or using the site under legal parental/guardian supervision.
You agree not to misuse, attempt unauthorized access, or disrupt our security.
All content (images, branding, text) is the property of SRM Foods & Spices. Unauthorized use or reproduction is strictly prohibited.
2. Product Information
We strive for accuracy; however, minor variations in color, packaging, and texture are natural for items like Saffron, honey, and walnuts. These do not constitute a “defect.”
3. Order Placement & Acceptance
You confirm that all provided details (name, shipping address, contact) are accurate.
An order is only accepted once dispatched. We reserve the right to cancel orders due to payment failure, stock unavailability, pricing errors, or suspected fraudulent activity.
4. Delivery & Shipping
Delivery timelines are estimates. We are not liable for third-party courier delays.
If a package is returned (RTO) due to an incorrect address or refusal at the doorstep, reshipping charges apply.
5. Payment & Partial COD Terms (Crucial)
Partial COD Advance: For orders utilizing our Partial COD model, a ₹160 advance payment is mandatory at checkout. This fee secures the order and covers logistics costs.
Forfeiture: You explicitly agree that if you refuse a delivery, provide an unreachable address, or fail to accept the parcel, this ₹160 advance is non-refundable and is forfeited to cover logistics and RTO penalties.
Prepaid Cancellations: For 100% prepaid orders cancelled by the customer before dispatch, we reserve the right to deduct a 2%–3% payment gateway processing fee from the refund, as this amount is non-refundable to us by the payment provider.
6. Return, Replacement & Refund Policy
All returns, replacements, and refunds are governed by our Return & Refund Policy, which is incorporated into these terms by reference. Please read it thoroughly before making a purchase.
7. Cancellation Policy
Orders can only be cancelled before dispatch. Once dispatched, cancellation is impossible. Any refusal of a dispatched parcel constitutes an RTO and will result in the forfeiture of the Partial COD advance payment.
8. Fraud Prevention
We monitor all transactions for suspicious patterns. We reserve the right to blacklist users for fake damage claims, repeated RTOs, or payment abuse. Legal action may be initiated for fraudulent behavior.
9. Limitation of Liability
Our total liability for any claim, including those arising from product usage or delivery delays, is strictly limited to the value of the purchased product. We are not liable for incidental, consequential, or indirect damages.
10. Indemnification
You agree to indemnify and hold harmless SRM Foods & Spices, its directors, and employees from any claims, losses, or expenses arising from your use of this website or misuse of our products.
11. Modification of Terms
We may update these Terms at any time. Your continued use of the website following an update signifies your acceptance of the revised terms.
12. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of India. Any disputes, claims, or legal proceedings shall be subject to the exclusive jurisdiction of the courts located in Srinagar, Kashmir, India.
